Abstract: Nowadays, in China, the society enjoys a rapid development speed, judicial practice is complicated, and theoretical innovations appear one after another. People often find that there are "several shortcomings" in legislation or justice, but they lack the methodology and interest and impulse to answer in the theoretical system. If the problem is the voice of the times, then reflection and criticism are the response to this voice. Reflection is the starting point for understanding problems, while criticism provides an opportunity to solve problems and pursue truth in methodology.
