Abstract: The development of artificial intelligence has raised some legal confusions, including the ethical restrictions on the research and application of artificial intelligence, whether artificial intelligence has the attributes of a legal subject, and the legal responsibility of artificial intelligence causing harm. For these issues, we try to conduct preliminary discussions from the standpoint of legal conservatism. These discussions run through the defense of human subjectivity and basic rights, the defense of the basic values of human civilization ("Major Human Civilization Boundary"), and the prevention of technical elites from abusing the power of artificial intelligence technology, and basic concepts such as preventing the abuse of public power under the guise of artificial intelligence. The conservatism legal theory of artificial intelligence includes: conservatism research and utilization view, conservatism legal subject view and conservatism legal responsibility view. We should pay attention to exploring the potential dangers of artificial intelligence as soon as possible, and strengthen the construction of legal mechanisms to prevent artificial intelligence alienation.
