Jiang Tiechu, Cry to Fold the Prison and the Tradition of Ancient China Case

Abstract: Cry to fold the prison is an important judicial philosophy in ancient China. Influenced by this, China's ancient judicial priority chose the less harmful way of hearing and restrict the adoption of more hazardous methods. The trial emphasized the discovery of truth. It emphasizes the combination of evidence and common sense and the multiple hearing .There was deviation among the system, idea and practice of Cry to fold the prison. It also underestimated the shortcomings of the facts and the mechanism of recognition.
